Please read these terms carefully. By booking, paying a deposit for, or boarding any vessel or tour operated or arranged by That Boat Guy Hvar ("we", "us", "our"), you ("the Client", "you") confirm that you have read, understood, and agreed to be bound by the terms set out below — on your own behalf and on behalf of every member of your party, including any minors in your care.

This Is The Sea

The Adriatic is a natural body of open water and its conditions are inherently variable and beyond our control.

Prior to every departure we assess the prevailing wind, swell, and forecast, and we will not knowingly depart in conditions we consider genuinely unsafe. However, sea and weather conditions can change without warning once a trip is underway. Movement of the vessel, spray, wave action, and a degree of physical discomfort are normal characteristics of boating and do not constitute a fault, defect, or failure of service.

Where you have been advised before departure that conditions are marginal and you have elected to proceed, you do so at your own discretion and risk. No refund will be issued on the grounds that sea conditions were rougher, wetter, or less comfortable than anticipated. Boats move on water. You may get wet.

Cancellations, Rescheduling & Refunds

We reserve the right to cancel, shorten, delay, or amend any trip at our sole and absolute discretion where we judge it necessary for reasons of safety, weather, sea state, mechanical condition, or operational requirement. The safety of our guests and crew, and the integrity of our vessel, will always take precedence over the completion of any individual trip.

If we cancel a trip in full before departure, you will be offered, at our discretion, either a full refund or a rescheduled date subject to availability. Where you cancel, our standard cancellation policy — disclosed and confirmed to you at the time of booking — shall apply. Trips curtailed after departure for reasons of safety, weather, or guest conduct are not eligible for refund except where required by applicable law.

Third-Party Attractions & Venues

Certain destinations featured during a trip are owned, operated, and controlled by independent third parties over whom we have no authority. In particular, the Blue Cave on the island of Biševo is operated by a separate organisation. We cannot guarantee, and accept no responsibility for, its opening hours, accessibility, queue times, entry fees, or whether conditions on a given day permit entry at all.

If the Blue Cave or any comparable attraction is closed, inaccessible, oversubscribed, or otherwise unavailable on the day of your trip, we are unable to refund your charter on that basis, as the charter — your boat, crew, fuel, and time on the water — has been provided as agreed. The same principle applies to any third-party beach club, bar, restaurant, mooring, or attraction visited during your trip. We are responsible for transporting you there safely. We are not responsible for the conduct, pricing, availability, or service of any independent venue once you arrive.

Authority Of The Skipper

Once aboard, the skipper holds full and final authority over the operation of the vessel and the safety of all persons on board. A vessel at sea is not a democracy.

Any decision made by the skipper — including but not limited to route, speed, timing, anchorage, the redistribution of passengers for weight and stability, or the early termination of a trip — is final and must be complied with promptly. Weight distribution materially affects the stability and safe handling of a boat. A boat is not a bus. Where you are asked to move or remain seated, you must do so immediately.

Failure to follow the lawful and reasonable instructions of the skipper may result in the trip being terminated without refund.

Alcohol, Conduct & Behaviour

The reasonable consumption of alcohol is permitted. However, where in the skipper's judgement any guest becomes a danger to themselves, to others, to the crew, or to the safe operation of the vessel — whether through intoxication or otherwise — the skipper may terminate the trip immediately and return the party to Hvar.

In such circumstances no refund, partial or full, will be provided, and the Client shall remain liable in full for any loss, damage, cleaning, or third-party cost arising from such conduct.

Fitness To Travel, Punctuality & Personal Condition

Trips depart and run to schedule. Where you or any member of your party arrives late, unwell, fatigued, hungover, or otherwise diminished as a result of the previous evening's activities or any other cause, the trip will proceed as originally scheduled and for its originally agreed duration.

We do not offer reduced rates, shortened pricing, partial days, or refunds on account of a guest's personal condition or late arrival. The night before is not our responsibility. Please plan accordingly.

Swimming & In-Water Activities

All swimming, snorkelling, diving, and any other in-water activity is undertaken entirely and voluntarily at your own risk.

You acknowledge that open-water swimming carries inherent and unavoidable risks — including currents, depth, water temperature, marine life, boat traffic, and fatigue — that cannot be eliminated regardless of the care taken. Before entering the water you are responsible for assessing your own ability and that of every member of your party.

You must inform the skipper before departure if you or anyone in your party is a non-swimmer or weak swimmer, has a relevant medical condition, or is travelling with children. Life jackets and flotation aids are carried on board and will be provided immediately on request, without question, to anyone at any time. By proceeding with the trip you confirm that you have been given the opportunity to request them and to declare any non-swimmers.

The skipper is responsible for the safe operation of the vessel. The skipper is not a lifeguard, is not engaged to supervise persons in the water, and cannot observe every guest at all times. Entry into the water is your decision and your responsibility.

Personal Belongings & Valuables

The marine environment is unforgiving to personal property. Rings slip off in cold water, phones go overboard, and sunglasses are lost the instant they touch the surface.

We accept no responsibility or liability whatsoever for any personal item lost, damaged, dropped, submerged, or otherwise rendered unusable during your trip, howsoever caused. Please do not bring aboard anything you are not fully prepared to lose.

Assumption Of Risk, Emergency Assistance & Limitation Of Liability

  1. Inherent risk. Boating, swimming, and related marine activities carry inherent risks that cannot be wholly eliminated, even when all reasonable care is taken. By booking and boarding, you knowingly and voluntarily assume those risks on behalf of yourself and every member of your party.
  2. Good-faith emergency assistance. In an emergency, the skipper and crew may take whatever action they reasonably judge necessary to protect life and safety — including attempting a rescue, administering first aid, or summoning assistance. Any such action is undertaken in good faith and in the interest of safety. To the fullest extent permitted by law, neither That Boat Guy Hvar nor its skippers or crew shall be liable for the outcome of any good-faith assistance or rescue attempt, nor for any decision reasonably taken in the exercise of judgement during an emergency.
  3. Limitation. To the fullest extent permitted by applicable law, That Boat Guy Hvar, its owner, skippers, and crew shall not be liable for any injury, illness, loss, delay, or damage suffered by any guest, save where caused directly by our proven negligence.
  4. Non-excludable liability. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded under the laws of the Republic of Croatia. Where any provision of these terms is found unenforceable, the remaining provisions continue in full force.

Damage To The Vessel & Equipment

You are responsible for the reasonable care of the vessel and its equipment during your trip. Any damage caused by the deliberate, reckless, or negligent act of any member of your party will be assessed and charged to the Client in full, including the cost of repair, replacement, cleaning, and any consequential loss of operating time.

Insurance

We strongly recommend that all guests hold valid personal travel and medical insurance appropriate to marine and water-based activities for the duration of their trip. We do not provide personal travel insurance on your behalf.

Minors

Any guest under the age of eighteen (18) must be accompanied by, and remain under the supervision of, a responsible adult at all times. The accompanying adult accepts full responsibility for the conduct and safety of any minor in their care.

Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, and any dispute arising shall be subject to the exclusive jurisdiction of the Croatian courts. Your statutory consumer rights are not affected by anything in these terms.

Amendments

We reserve the right to update or amend these terms at any time. The version in force at the time of your booking shall apply to that booking.
